The business establishment is based on two sets of elements, corporeal and incorporeal. At the beginning, people recognized the importance of the corporeal elements such as goods, tools, and the furniture of the business establishment. The significance of the incorporeal elements was not acknowledged because of two reasons. First, the incorporeal elements were an abstract concept couldn’t be seen or touched. Second, most of the incorporeal elements such as the licensing, exclusivity, and patents did not exist back then. After the growth of commerce and the competitions between merchants, the necessity of some incorporeal elements such as the physical address of the business establishment, name, logo, and good will were emerged. Based on this changes, many counties started to pass laws to put in order the creation of the business establishment. Lebanese lawmakers passed a Legislative Decree in 7/11/1967, which organize every aspect of a business establishment. Since the 7/11 Legislative Decree, Lebanese authority did not make any amendment to meet up the commerce evolvement including the e-business. Thus, there are many inquiries about the legal existence of the e-business establishment and the capability of applying the Legislative Decree no 7/11 on the e-business establishment. This is true since the Legislative Decree no 7/11 does not mention any thing about the creation, operation, and or the protection of the e-business establishment. This paper is to investigate the elements of the e-business establishment and the measures of protecting it. © 2016 The Authors. Published by European Science publishing Ltd.
