Economic, social, cultural rights is the second generation of human rights which includes the right to work, education, housing, health, adequate food and cultural. The survey on Economic, Social and Cultural Rights is considered in the history of Iran. In this paper these rights has been studied in four historic document known as the Charter of Great Cyrus, Code of Hammurabi, Medina constitution and the constitution of Iran. The legal documents such as property rights, housing rights, cultural rights and respect for the customs and social insurance, the right to a nationality and the right to have a free and compulsory education, which are comparable with the modern international instruments, are investigated. This research allows us to belief ourselves and to see that our history has also had great share in human rights literature. Then we can build up our own human rights based on the roots of own history and own culture. © 2016 The Authors. Published by European Science publishing Ltd.
